St. Louis, 2011 - Three Charged With Looting Damaged Sunset Hills Homes (St. Louis Post Dispatch) Despite highly inflammatory media coverage, Lozano negotiated an SIS (no criminal conviction) and one year bench probation for three Bosnian nationals who were crucified in the media, preserving their good standing immigration status. "There was much more to this story than what was presented on its face in the paper, " said Lozano. "This was more about cultural and language barriers than criminal conduct." We are currently representing clients in state and federal court for serious to minor criminal matters, including drug trafficking, armed criminal action, 2nd degree murder, 1st degree assault with serious injury, sexual assault, embezzlement, DWI and other offenses.
Some recent case results:
Three Separate Class C Felony Drug Possession Cases: Client was charged in three separate cases in St. Louis City with possession of a controlled substance. The State's recommendation was 10 years incarceration. Defendant asked for and received an SES, 2 years probation. No jail time to be served.
Probation Revocation Child Support (class D felony): Defendant absconded for three years on an SIS sentence of felony non-support. Probation Officer recommended 4 years imprisonment. Defense argued for and was granted denial of the revocation conditioned on a payment schedule.
Probation Revocation Possession with Intent to Distribute (class B felony): Prosecuting attorney recommended 5 years imprisonment. Defense requested and was granted continuation of probation without a conviction.
Felony Stealing (class C felony): After complex negotiations,three foreign nationals received a significantly reduced period of probation that allowed them to remain in good standing with U.S. Immigration and not be deported.
Leaving the Scene of an Accident (class A misdemeanor): Dismissed.
Bond Reduction: Reduced trom $20,000 cash only to Personal Recognizance.
Altered Drivers License (class A misdemeanor): Dismissed.
Failure to Pay Child Support (class D felony): Suspended Imposition of Sentence.
Unauthorized Use of a Credit Device, $30,000 (federal court, class B felony): Possible Range: 0-20 years; Sentenced to 4 months.
Probation Revocation (class B felony): Possible sentence of five years; probation reinstated.
Theft (class C felony): Amended to Suspended Imposition of Sentence, 1 year unsupervised probation.
Drug Paraphernalia: Amended to improper muffler plus fine
Promoting Prostitution: Amended to improper muffler plus fine.
Minor in Possession: Amended to illegal parking.
DWI: Suspended Imposition of Sentence.
Felony DWI (Arch grounds): Fine.
Minor in Possession: Dismissed.
Drug Paraphernalia: Fine.
Drug Trafficking (class B felony): Suspended Imposition of Sentence, 30 days shock.
Possession of a Controlled Substance: Improper parking plus fine.
Drug Trafficking: 120 day call back.
Driving While Suspended: Suspended Imposition of Sentence plus fine
