If you or someone you know has been arrested, here is what you should do and what to expect:
- Request to speak with an attorney. This will end a police interrogation. Call me immediately at 314-456-4567. Do NOT give a statement, get chatty with the police or try and talk your way out of anything. A police investigation is like quick sand...you can only sink. Stay calm and stay quiet.
- 24 hour hold. Under Missouri law, the police may detain you for up to 24 hours at which time they must either release or charge you.
- Setting and posting bond. If you are charged, bond may or may not be set. It is imperative that you retain an attorney immediately so that bond can be set. On lesser charges, it is common to be released on your own recognizance (no bond required) or at a reduced bond. Frequently bond is set and upon the entry of an attorney, it is reduced or 10% is authorized upon motion or agreement with the prosecutor. For example, if your initial bond is set at $15,000, if 10% is authorized, you will only need to post $1,500.
- Bond assignments. I accept bond assignments in many cases. This means that the bond that you post may also be used to pay all or a portion of your legal fees.
- Warrant status. If there is a warrant out for your arrest, hire an attorney before surrendering. An attorney can make bond arrangements and coordinate other logistical issues to minimize your time in booking. Check Missouri Casenet to see if you have a pending case in state court.
- The next step. Once bond is posted and you have been booked, you will be released. The next step is generally arraignment in which you will enter a plea of not guilty. Most criminal cases have numerous routine court appearances before it is resolved. One of the trickiest parts is the arrest, surrender and bond stage. This is why you need to hire an attorney immediately. Many accused sit needlessly in jail awaiting resolution of their case. Some may wait many months or even years!
St. Louis, 2011 - Three Charged With Looting Damaged Sunset Hills Homes (St. Louis Post Dispatch) Despite highly inflammatory media coverage, Lozano negotiated an SIS (no criminal conviction) and one year bench probation for three Bosnian nationals who were crucified in the media, preserving their good standing immigration status. "There was much more to this story than what was presented on its face in the paper, " said Lozano. "This was more about cultural and language barriers than criminal conduct." Good lawyering, diligence and persistence led to an excellent result for the accused.
